Terms of Business

We believe in clarity at Tree Central. Here’s what you need to know about our quote and how we work together:

  1. Quote Validity
    Our quote is valid for 30 days from the issue date. After 30 days, costs may change due to site conditions or other factors.

  2. What’s Included
    The quote covers only the work listed. Anything extra will be treated as a variation and may cost more. Hidden issues, including underground obstacles or tree decay, can also affect pricing.

  3. Pricing & Extras
    Prices are in NZD, excluding GST unless stated. Waste transfer station fees, dump fees, and materials are not included unless specifically mentioned. Extra charges may apply for additional labour, machinery, or difficult access. Any hourly rates quoted refer to man-hours, meaning multiple crew members on site are charged per person, per hour.

  4. Access & Site Safety
    Safe and clear access must be provided. Delays caused by obstacles, pets, or vehicles may incur additional charges. We follow all New Zealand health and safety rules.

  5. Permissions & Consents
    You are responsible for obtaining any required council or neighbour permissions. We are not liable for any breaches unless agreed in writing.

  6. Changes & Variations
    Any changes to the quote must be agreed by both parties. Variations will be charged at an agreed rate or our standard hourly rate.

  7. Payment Terms
    Our invoices are due for payment on issue. You agree to pay all invoiced amounts even if there is a dispute relating to that invoice or any other invoice. Any unresolved disputes will be handled in accordance with clause 8 (Resolving Disputes).

If payment is not received within 14 days of the invoice date, we reserve the right to suspend or terminate services in whole or in part, retain or withhold any information or work related to the services, and charge interest on the outstanding amount. Interest will be charged at a rate equivalent to the Inland Revenue Department use-of-money interest rate under the Tax Administration Act 1994 plus 5% per annum for balances less than 90 days overdue, and plus 10% per annum for balances more than 90 days overdue.

You agree to pay all reasonable costs we incur in complying with any statutory obligation, court order, or compulsory process relating to you or the services. You also agree to pay all expenses and administration fees relating to overdue amounts, including debt collection agency costs, legal fees on a solicitor/client basis, and administration costs. These Terms continue to apply after termination of services until all outstanding amounts are paid in full.

  1. Resolving Disputes
    This agreement is governed by New Zealand law. If a dispute arises, both parties agree to attempt to resolve it in good faith through discussion and/or mediation. If the dispute cannot be resolved, it will be subject to the exclusive jurisdiction of the New Zealand courts.

  2. Cancellations & Delays
    Reasonable notice must be given for cancellations or rescheduling. Late cancellations may incur fees. We are not responsible for delays caused by weather, equipment failure, or other unforeseen circumstances.

  3. Liability & Damage
    We take care, but minor ground or garden disturbance may occur. We are not liable for pre-existing defects, hidden problems, or undisclosed items. Liability is limited to the value of the work carried out.

  4. Timber & Mulch
    Unless stated otherwise, all timber, mulch, and debris are removed from site. If you request materials to remain onsite, placement will be at our discretion.

  5. Acceptance
    Accepting the quote, whether in writing, verbally, or by instructing us to proceed, constitutes acceptance of these Terms.
